• Design Content: Patterns, motifs, palettes, images, files, project data, comments, and other creative content you create, upload, or store in the Service (“Design Content”).

Information Collected Automatically

• Usage Data: Information about how you use the Service (features used, actions taken, session duration, error events, interactions).

• Device & Technical Data: Browser type, operating system, device identifiers, language settings, approximate location (derived from IP), screen resolution.

• Log Data: IP address, access times, pages viewed, referring URLs, and system activity.

• Cookies & Similar Technologies: Cookies, pixels, SDKs, and local storage used for authentication, preferences, analytics, and (where enabled) marketing.

Information from Third Parties

• Authentication Providers: If you sign in via Google/Apple or other providers, we receive basic profile info (e.g., name, email) as permitted by your settings.

• AI Service Providers: If you use AI features, certain inputs (for example, text prompts or uploaded images) may be processed by third-party AI providers to generate outputs.

• Payment Processors: We receive limited transaction metadata (e.g., payment status, plan type, renewal date, last 4 digits, country) from our payment processors.

How We Use Your Information

We use information we collect to:

• Provide and operate the Service (authentication, saving projects, rendering previews, exporting files).

• Process transactions and manage subscriptions, invoices, and receipts.

• Create and manage your account and preferences.

• Provide customer support and respond to requests.

• Send service and administrative communications (security alerts, confirmations, policy updates).

• Deliver AI-powered features (pattern generation, image processing, enhancements), including sending necessary inputs to AI providers when you choose to use those features.

• Improve the Service (debugging, performance monitoring, feature development, analytics).

• Maintain security (fraud prevention, abuse detection, access controls).

• Comply with legal obligations and enforce our agreements.

Legal Bases for Processing (EEA/UK)

If you are located in the EEA/UK (or where similar laws apply), we process your personal data under these legal bases:

• Contract: To provide the Service you request (e.g., account, storage, exports, billing).

• Legitimate Interests: To secure, maintain, and improve the Service (e.g., analytics, fraud prevention, product improvement).

• Consent: For optional cookies (where required), and marketing communications in certain jurisdictions.

• Legal Obligation: To comply with applicable laws (tax, accounting, regulatory, lawful requests).

How We Share Your Information

We do not sell your personal information. We may share information as follows:

Service Providers (Subprocessors)

We may share information with vendors that help us operate the Service, such as:

• Cloud hosting and storage

• Database and infrastructure providers

• Analytics and performance monitoring

• Customer support tools

• Email delivery providers

• Payment processors

• AI processing providers (when you use AI features)

These providers are authorized to process personal data only as needed to provide services to us and are required to protect it.

AI Processing

When you use AI-powered features, your AI inputs (such as prompts or uploaded images) and necessary technical data may be sent to third-party AI providers to generate outputs and return results to you. These providers process data according to their own terms and privacy policies and, where available, we aim to use settings and contractual controls that restrict use of inputs for provider training.

Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction.

Legal Requirements and Protection

We may disclose information if we believe in good faith that disclosure is necessary to:

• comply with law, regulation, legal process, or governmental request;

• protect the rights, property, and safety of JACQ Art, our users, or others;

• prevent fraud, security incidents, or abuse.

With Your Consent

We may share information when you instruct us to do so or give explicit permission.

• enable exporting/sharing features you choose to use,

• provide support and troubleshoot issues you report.

AI Training

We do not use your private Design Content to train AI models without your explicit consent. If we ever offer an opt-in program (e.g., to improve models), we will clearly disclose it and require affirmative consent.

7Sharing Controls

Your designs are private by default unless you choose to share, publish, or collaborate with others. You control sharing settings available in the Service.

Data Retention

We retain information for as long as needed to provide the Service and for legitimate business and legal purposes.

• Account & profile data: retained while your account is active. After deletion, we generally delete or de-identify it within 30 days, unless longer retention is required for legal/security reasons.

• Design Content: after account deletion, we generally delete Design Content within 90 days (including active systems).

• Backups: backup copies may persist for up to 180 days before being overwritten or deleted on a rolling basis.

• Billing and tax records: we may retain invoices, receipts, and related transaction records for the period required by applicable law (often several years).

• Analytics: we may retain aggregated or de-identified analytics data for longer periods.

Retention can vary depending on legal obligations, dispute resolution, and security requirements.

We implement appropriate technical and organizational measures to protect information, which may include:

• encryption in transit (TLS/SSL) and, where appropriate, encryption at rest;

• access controls and authentication safeguards;

• monitoring for suspicious activity;

• regular maintenance and security reviews.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your login credentials and restricting access to your account.
